STRATFORD — For anyone who doesn’t know much about the town’s Ethics Commission, you’re about to find out.

As part of the panel’s new ethics code proposals, which include a strong anti-nepotism policy, the commission has launched a townwide campaign to remind citizens they can file complaints whenever they believe there has been a violation.

As part of that campaign, the panel has taken a step it believes no other ethics board in Connecticut has ever done.

The commission members have put up 100 posters around town, in both public and private venues, that include a color photograph of the six-member commission, with their names listed, some messages for town residents, and how the panel can be contacted.

Led by Chairwoman Susan Birge, the commission includes Roger Salls, Jack Golden, Daniel Rodriguez, Everett Sussman and Steve Biley. Some of the posters are hanging in Town Hall, the Birdseye Municipal Complex, Baldwin Senior Center, South End Community Center, Stratford Public Library, and other public and private locations.

“The ethics code is intended to promote public confidence in the integrity of the town’s government and administration,” the poster states. “Ethical conduct is essential for trust in local government.”

The poster also states the following:

“If you believe a violation of the Ethics Code may have occurred, submit a complaint.

“If you have a question about a possible violation of the Ethics Code by a public official or town employee, contract the Ethics Commission for an Advisory Opinion….

    Jezebel’s post has two accuracies: 1). The Ethics Complaint Form and seven copies must be completed and notarized with supporting/relevant documentation/evidence accompanying the complaint, and 2). The Complaint Form (in a sealed envelope – no return information is needed) should be given/mailed to the Town Clerk, who in turn, gives it to the Ethics Commission.

    The current Ethics Code requires seven copies. In the proposed revisions to the Ethics Code, copies are not needed. We believe that requiring seven copies puts an undo burden on a citizen submitting a complaint.

    The Ethics Code states that: “Within twenty (20) business days of receiving a complaint, the Commission shall determine whether the allegations in the complaint, if true, would constitute a violation of the Code… The complainant shall be notified of the outcome within five (5) business days after the determination has been made.” The Ethics Commission has always adhered to the prescribed time requirements identified in the Ethics Code.

    Jezebel’s inference that the Ethics Commission would do harm to a citizen, public official or municipal employee who submitted a complaint is not only categorically untrue but very offensive. The citizens, whom I have served with on the Ethics Commission, since 2002, have all been fine men and women whose only motive for serving on this Commission has been to be “do the right thing for Stratford”. Please take the time to read the short bios of the Commissioners on the Ethics web page. These are people who care about the Town of Stratford and are trying to make a contribution to better our community.

    Over the years, we have reviewed numerous complaints. In many instances, we agreed with the complainant. We believed the behavior described was “unethical”, “unfair” and/or “inappropriate”. However, we are not charged with subjectively deciding what conduct is ethical; rather, we are charged with the “administration and enforcement of the Ethics Code”. If the alleged behavior did not violate a specific “prohibited activity” in the Code or if we were not provided with substantive information, we could not advance the complaint along in the process. It has not been unusual for the Ethics Commission to encourage the complainant to resubmit the complaint. Our correspondences in these instances states: “You are welcome to resubmit a complaint(s) with more specific evidence of an explicit “Prohibited Activity” as articulated in the Ethics Code.”

    There have been some complaints that we believed were in violation of the Ethics Code; however, the statute of limitation in the current Ethics Code is two years, which precluded us from advancing the investigation. In the proposed revisions to the Ethics Code, we have changed the statute of limitations from 2 years to 4 years.

    The Ethics Code requires confidentiality until a complaint progresses to a public hearing. This is to protect both the complainant and the individual who has been alleged to have violated the Ethics Code.

    The Ethics Commissioners are committed to being objective and thorough. We take our responsibilities very seriously and are we are trying to do the best for the Town of Stratford. Our submission of revisions to the Ethics Code, if passed, will enhance the Stratford Ethics Code. Our “Ethics Awareness Campaign” is intended to put ethics out in front, to inform the townspeople about the Ethics Code and who the Commissioners are, and to empower citizenry to participate in government.

    On behalf of the Ethics Commission, I encourage anyone who has suggestions on how we can better serve, to please come to our next meeting on July 20th. Should you have opinions concerning the proposed revisions to the Ethics Code, please express them at the Ordinance Committee meeting on July 27th. Also we have three vacancies on the Ethics Commission, if interested in being part of this group, please submit your name…let’s work together!

    Ms. Birge,

    I strongly suggest you modify the Town Website. Those instructions were taken directly from there.

    I also strongly suggest that complaints be submitted directly to a member of the Ethics Commission since handing it to a Town Clerk appointed by the mayor (whom is in charge of all personnel issues including all at-will employees) is, well, silly. Especially if the complaint is about the mayor or one of his appointees.

    At no time did I infer that you or a member of the Ethics Commission would do the harm.

    However, since you are obviously reading this, maybe you can answer why the Commission is unable to take action on it’s own.

    Thank you for your reply and clarification. I now understand that you meant exposure to the Town Clerk could result in retailiation, not filing an Ethics Complaint per se. I like your suggestion that complaint go directly to the Ethics Commission. I will bring it to the Commissioners at our meeting on 7/20.

    According to Sec. 5-29 C of the Ethics Code, the Ethics Commisison may initiate a complaint by vote of a majority of members present and voting at a meeting at which a quorum is present.

    We hope yhat the Council act on our proposed revisions to the Ethics Code in August. The web information will be updated to reflect changes and a new complaint form. I also like the idea of keeping a copy of the complaint under the pillow, maybe we’ll include that too 😉

    and you were Recording secretary.
    1A) Disposition of those complaint and date?
    1B) Documented reasons for disposition?

    2) Why Robert Chaloux recused himself on complaint vs.
    Esq. Burturla by Fredette / Proto, who had complaint
    filed against Fredette by (?) who was a Gavin / Calzone
    EMS worker / friend / supporter?
    2a) What were the specific subjects of the complaints?

    3) How much has been paid in attorney fees by the Town,
    specifically and to whom and when?

    4) Your (past) relationships with Esq, Berchem, Burturla and
    others, per your employer and socially?

    5) Why / When qualifications to be on the Ethics Commission
    were changed, and by whom?

    6) Are there Conflicts of Interest on EVERY MEMBER of the ETHICS
    Commission who have been appointed, since it was vacant?

    7) Is your Commission another self reinforcing political
    power grab?

    What difference is there between the BIG LIES of the NAZIs
    and the controllers of the Democratic and Republican parties?

    I would like to note that I believe Ms. Birge is well intended
    and was absent that date of the meeting where my multiple
    complaints were crushed by Father (now Bishop Kopka) who
    privately discussed the situation years later and I forgave him.

    I also find people are blindsided by their own conflicts of
    interest.

    Obviously either she or an ally saw the blog post.

    However it is sad that she has not rebutted my contentions.

    When someone very promptly protests teasing post (by Jeze),
    but is then challenged, and does not even try to DENY or REBUT,
    would any REASONABLE READER CONCLUDE …..

    Dick Miron helped change qualifications of vacant Commission.

    Republican dominated Town Council – Gave DICK MIRON raise to
    $ 28,000 year + Health / other Benefits of 20 hour work week.

    included Town Attorney Kevin Kelly’s Brother in Law – Kevin Williams
    Kelly and Burturla swap Town Legal cases for 10 years and who knows,
    maybe swap spit?
    Burturla & Miron kept Florek in loop same 20 years Dick Miron messed
    over Stratford – yet YOU people think Florek has OUNCE of INTEGRITY?
    – Yeah he is JOVIAL – But so is SANTA CLAUS, to whom he panders to
    politically to Republican Parasites, who aren’t any better than Mirons.

    Laura Hoydic relative on CRC # 1. SHE MANAGES station house square

    Norm backs Harkins and probably behind Costello, who had Fund Raiser

    than MONEY that would be paid to 401 or DEFINED CONTRIBUTION PLAN,
    then it is a NON ISSUE to me.

    However EVERY MANAGMENT PENSIONER knows they are LYING THIEVES
    with ZERO social conscience, because people with limited income may
    have died, suffered, and lost homes or moved out of town, because
    COLLECTIVELY they were all in it for themselves and could care less

    I cannot disclose any information concerning prior complaints. Additionally, I will not confirm or deny that these cases came to the Ethics Commission. I don’t mean to sound curt, but if the Chairperson of Ethics doesn’t uphold the Code…

    I assume you mean legal costs involving Ethics Complaints. Over the past five years, we have occasionally (maybe 4 times) consulted with the Town Attorney for legal interpretation of the Ethics Code. As you know the Town Attorney has also provided the Mayor and Town Council with opinions regarding our proposed revisions to the Ethics Code – this is part of his job/responsibilities. In 2005 and early 2006, the Ethics Commission had a complaint that went to a “probable cause hearing”. We used a private attorney who did not live in Stratford to serve as legal council for that matter. The Town Attorney approved our hiring of the private attorney and payment was made through the Town Attorney’s Office – if memory serves, I think it was about $5,000.

    Rich Buturla and I have known each other for years through our involvement with the Town. I have always enjoyed a professional and respectful working relationship with him. I don’t know of him having any relationship with Fairfield University. I did see him at a basketball game about 4 years ago – I don’t think he was not cheering for Fairfield U., but I’m not certain. I’m pretty sure Fairfield U won the game though 😉

    I do not know Robert Berchem. He was a member of the Fairfield University Board of Trustees from 1991 to 1996. I started working at Fairfield U in 1996. He is currently a member of the University of Bridgeport’s Board of Trustees (I had worked there until 1996) – so we keep missing each other! I’ve heard many positive things about Attorney Berchem. I would like to meet him someday.

    For George’s questions about “qualifications for Ethics Commissioners, power grabbing, big lies and Nazis as well as your past experience with Fairfield University and Jesuits” –

    I choose not to respond, except to express how truly impressed I am with my fellow commissioners – they are fine people and are trying to do the right thing on behalf of the people of Stratford. It would probably be more interesting for pundits and bloggers if the Stratford Ethics Commissioners were self-serving, unethical, power-hungry, egotists fraught with conflicts of interest – that is simply not the case! As for Fairfield University, it is a fine institution, steeped in Jesuit values. I am proud to be a member of this University community.

    George, I will not be responding to further questions about Commissioners or negative comments about the Ethics Commission on this blog. However, I welcome feedback and am delighted to receive suggestions, but I believe it is more heuristic for members of the public to voice their opinions to the Ethics Commission at one of our meetings. I believe we all want the best for our Town – so again, let’s work together for Stratford!

    No. Of course not. For example, when Pat Ulatowski was hired by the Town in 1968 the Town had a pension plan as did most companies. She performed her jobs efficiently and effectively for 40 years, rising to the position of Town Clerk. And, by the way, in all 40 of those years, she was never paid any overtime. Is she not entitled to the fulfillment of her contract?

    Diane Toolan worked her butt off to get grants for playgrounds, handicapped accessibility, shopping centers…..

    While there may be many that have scammed the system as you believe, there are others that have dedicated themselves to serving Stratford residents for not so much money.

    Perhaps the Ethics Commission can initiate it’s own action and render a decision on this:

    Chief: Report finds Stratford officer in crash had seizure

    It seems at the very least there is a hint of unethical behavior here. There is everything you need as well: Named witnesses, documentation, police reports, nepotism, disregarded evidence……

    In my humble opinion, an ethics investigation of this…incident… would go a long way towards restoring credibility to your commission.

    Perhaps you are hiding behind rules, that you helped create,
    while limiting your answers, to your advantage.

    Politically and Legally appropriate? Probably?

    If it was your family and friends who died, very possibly at the
    hands of people set up the Burturla’s and others – I suspect
    you would desire a more responsive, more honest, and more
    ethical actions.

    I would agree that all of your people appear to be pillars of
    the community, with great resumes.
    But then – so did Bernie Madoff.

    They are probably nice to pets, their families, and their friends.
    However, do they believe in and practice equal protection of the
    Law, and are they willing to do the ethical things related to the

    I believe you were unethically evasive on my direct questions on
    my Ethics complaint!

    I believe you know attorneys for both sides of the first 2 ethics
    complaints were paid by the Town?
    Not just the winner’s attorney.
    But also the winning and losing attorneys.

    I believe you know the first 2 complaints related to Pensions
    were pretextual to touch Pension issues and make it appear
    there was nothing going on, while both sides buddies were
    looting the system?

    Something never published by the Newsapapers, are the direct
    results of your actions and inactions – listing TOP PENSIONS +
    Base Pay in website content page:

    Because so many people in the Pension Befined Benefit Plan
    appear to be related via last name (I didn’t put up whole list)
    I wonder how many more are in-laws & cousins with different
    last names?

    These types of abuse are epidemic and systemic.

    Stratford headlines are well deserved, exactly because of the
    types of people who place friendship, back scratching patronage,
    and legalized graft above their fiduciary and ethical mandate.

    Susan, some of your friends remind me of the crew in high
    school that found ways to cheat on tests to keep up their
    appearances.

    I can’t wait until the next pretextual WHITE WASH and/or
    ABUSE of DISCRETION by the ETHICS Commission.

    Susan – What had the recomposed Ethics Commission actually
    accomplished with reconsitution 5 years ago, while there has
    been 2 decades of Stratford being abused by the usual suspects
    starting with Esq. Burturla, your long term ….?

    Disclaimer: I have many friends. Some of them take it upon themselves to do things without my permission. Like having kids, moving, making more money than me…..

    Put the paint brush down. There are abuses of policy everywhere. I certainly would expect an officer who gets shot and critically incapacitated or a fireman who is badly and permanently burned and injured to get at least 20 times, if not more of his contribution to his pension. Particularly if he/she is young.

    Then I read George’s 7/18 post and just shook my head. There really is no point after a post like that.

    Maxx-sometimes you just have to scroll on by when George gets on his conspiracy rant, but some times he has some valid points hidden in there.
    Here is a question for you Maxx, why do you think that the ethics commission has not conducted it’s own investigation into the current hiring issues in town? This is an issue that will plague the town for years to come if it is not dealt with. They need to look into it by their own vote and if any violations are found the message should be loud and clear-IT WILL NOT BE TOLERATED! It is going to take courage on their parts but do you think they would actually do it?

    The problem with filing a complaint with the Ethics Commission is that you need to provide evidence or documentation. How is a common citizen going to get the documentation needed to file a complaint against the Mayor for the Justin Loschiavo hiring? Doctor’s reports? Background investigation results?

    Go back and read Susan’s posts again. The Commission only opines on violations of the current Ethics Code. What hiring issues are in violation of the currently enacted Town Code? Or are they more like the $500k granite curbs on West Broad Street? Unfathomable and unconscionable, but not in violation of any specific legal issue.

    In reading the complaint form, Section 5-34B refers to Use of Influence. I’m thinking that the Mayor used improper influence to get Justin Loschiavo hired.

    Also, section 5-34A refers to Conflict of Interest. Wouldn’t Attorney Buturla have a conflict of interest issuing an opinion or being involved in discussions relating to the anti-nepotism ordinance since his brother is the Chief of Police?

    Had Green Card people and behind iron curtain

    2 – Chaloux – recused himself from complaint vs Burturla by Fredette
    on Pension issues, because his wife hire Burturla’s daughter for their
    family day care, of which he is an officer.
    That was ethical
    However was it ethical / conflicted for him to apply.

    3 – Birge – related to Goodrich – Mayoral candidate.
    Worked same place F. U. where Berchem was Director.
    Ethically admits long time relationship (causal) with Burturla.

    4. Mrs. DeRose = lifetime friend Dick Miron.

    5. Milt McDonald = applied to Ethics Commission to Dick Miron,
    not to Town Council / Manager.
    Started Fairfield chamber of Commerce a quasi-government business,
    which is VERY cozy with Municipalities and Businesses.

    6. O’Sullivan – Former U.S. State Dept – War College.
    Was in Belgium Congo 1960s – when CIA was involved in illegal War.

    7. Deb Gilbert Taylor – resume filled with politically connected
    businesses – Sterling House (part funding from Stfd) – A Chamber –
    Regional Business Council.
    All very cozy with Business / Municipals / state

    8. Michael DeJospeh – CT. Asst Prosecutor who I believe
    was inserted to protect Bridgeport CT. Prosecutors and
    Police Chief Mossman and Norwalk DePanfilis – I believe.
    When Kopka stepped on my complaints vs. Miron / Burturla
    / Mossman / Barnhart / Cabrol, which were filed late on a
    Friday for a Monday Meeting – thus a violation of FOI – I was
    livid at him backing Kopka with the others
    (Birge was absent)

    I told him a BILL OF PARTICULARS should be filed vs. ALL of
    them for their ETHICS / CRIMINALITY (in my opinion)

    DeJoseph’s jaw dropped and eye bulged as he was stunned.
    HE NEVER NEVER SHOWED UP TO ANOTHER ETHICS MEETING,
    to my KNOWLEDGE!

    There are NO DIFFERENCES between the 2 political parties and
    the SO VIET Communist party.

    There also “happened” to be a low flying Helicopter
    about 11:30 am coming from inland towards the river.

    It was not a “black ops”

    Nor was it a gun ship.

    It did have the side door open and a GI causally
    riding with one leg out the door.

    Unusual was the low height and coming from inland.

    I see the Helios flying over the Housatonic River all the time
    on their way to / from Sikorsky. They seem to always be at
    least 1,000 feet up.

    Today was only a few hundred feet up and a couple hundred
    yards away, because at my age, distance …. sight …

    It was a single helio.

    According to Ms. Birge under section 5-29C the ethics commission can by a majority vote initiate a complaint. Why haven’t they? They see what is happening-at the very least they should be investigating daddy and mommy Loschiavo and it should expand to the mayor(and his brother) as well as the Buturla boys. Why should citizens have to go make a gazillion copies and get them all noterized when we have a body of commissioners that can do it without all the hoopla? If this commission wants the public to really believe that they will do their job maybe they should take some actions on their own to show the community that they are serious.

    Where Amy should be the Town council chair,
    it appears Burturla / Miron will want Tony Ross.
    As a retired / pensioned Stratford fireman,
    I would think he is ethically conflicted.
    However in Burturlas / Miron’s world
    like Nixon going to china, they probably have it set
    up for Tony ross to solve the Fireman pension issue.

    Miron ran off an impressive list of accomplishments.

    However I suspect PCS would dispute his claims
    about the Rail Road Station

    and Save Stratford might dispute his and Fahan’s leadership
    on the RAYMARK dump site.

    Because Fahan “outed” Miron’s sister’s story and was Gavin’s
    campaign manager, Schirillo made Fahan get up in front of
    everyone and eat the RAT about fealty to the Mayor.

    I was amazed at all the cars in the Baldwin / Perry Parking lot.

    I thought Democrats were “Green” and car pooled or took
    bikes or drove small cars.

    Actually since Democrats actually have women and minorities
    on the Town Committee, unlike the Repubicans, there were
    a lot of sensible Mileage cars and very few HUMMERS. 😉

    Yeah…..it is COMPLETELY realistic in a town of 50k to expect people who are socially inclined enough to want to get involved in the Town by VOLUNTEERING for the Ethics Commission to have ABSOLUTELY NO TIES whatsoever in any regard at any time in their life to anyone else in the town who is socially inclined enough to want to get involved by running for office. They shouldn’t have even crossed paths in Aisle 7 of Stop and Shop, or else George would call it a conflict because they both prefer Ronzoni over Fratelli.

    And what does what O’Sullivan did 40 years ago half way around the world have to do with Stratford Ethics?

    According to Sec. 5-29 C of the Ethics Code, the Ethics Commisison may initiate a complaint by vote of a majority of members present and voting at a meeting at which a quorum is present.

    We hope that the Council act on our proposed revisions to the Ethics Code in August. The web information will be updated to reflect changes and a new complaint form. I also like the idea of keeping a copy of the complaint under the pillow, maybe we’ll include that too ….

    The citizens, whom I have served with on the Ethics Commission, since 2002, have all been fine men and women whose only motive for serving on this Commission has been to be “do the right thing for Stratford”. Please take the time to read the short bios of the Commissioners on the Ethics web page. These are people who care about the Town of Stratford and are trying to make a contribution to better our community.

    Over the years, we have reviewed numerous complaints. In many instances, we agreed with the complainant. We believed the behavior described was “unethical”, “unfair” and/or “inappropriate”. However, we are not charged with subjectively deciding what conduct is ethical; rather, we are charged with the “administration and enforcement of the Ethics Code”. If the alleged behavior did not violate a specific “prohibited activity” in the Code or if we were not provided with substantive information, we could not advance the complaint along in the process. It has not been unusual for the Ethics Commission to encourage the complainant to resubmit the complaint. Our correspondences in these instances states: “You are welcome to resubmit a complaint(s) with more specific evidence of an explicit “Prohibited Activity” as articulated in the Ethics Code.”

    There have been some complaints that we believed were in violation of the Ethics Code; however, the statute of limitation in the current Ethics Code is two years, which precluded us from advancing the investigation. In the proposed revisions to the Ethics Code, we have changed the statute of limitations from 2 years to 4 years.

    The Ethics Code requires confidentiality until a complaint progresses to a public hearing. This is to protect both the complainant and the individual who has been alleged to have violated the Ethics Code.

    The Ethics Commissioners are committed to being objective and thorough. We take our responsibilities very seriously and are we are trying to do the best for the Town of Stratford. Our submission of revisions to the Ethics Code, if passed, will enhance the Stratford Ethics Code. Our “Ethics Awareness Campaign” is intended to put ethics out in front, to inform the townspeople about the Ethics Code and who the Commissioners are, and to empower citizenry to participate in government.

    On behalf of the Ethics Commission, I encourage anyone who has suggestions on how we can better serve, to please come to our next meeting on July 20th. Should you have opinions concerning the proposed revisions to the Ethics Code, please express them at the Ordinance Committee meeting on July 27th. Also we have three vacancies on the Ethics Commission, if interested in being part of this group, please submit your name…let’s work together!

    Richard Burturla has been a Town Attorney and Assistant Town Attorney.

    to continue to control that case.

    So Ms. Birge, now that you have elected officials with better plausible
    deniability and Ethics Commissioners with plausible deniability, you now
    have placed yourselves to appear like “Caesar’s wife.”

    Maybe we should again ask Ms. Birge why her committee has not looked into the abuse of power by the Loschiavo family-that is one action her commission could take all on its own-this committee needs to prove itself credible-so far it has not especially after listening to their changes that are proposed. It is indeed unfortunate that they have chosen to make it an impossible situation which will perpetuate the current problems–but then again maybe that is what they have been directed to do by James or Rich. I am going to see if they are truly what they say they are by seeing if they will initiate actionon their own.

    Good luck with that. There have been so many issues in the past 4 years that if they were to take any action they would have had ample opportunity. No bid contracts, the use of private investigators with taxpayer money, 3 (or is it 4?) CHRO investigations, pension buyouts, corrupt hiring, personal use of town vehicles, golf trips, excursions to Mohegan Sun and it just goes on and on.

    The existence of an Ethics Commission is simply to say that we have one and they have found no violations. After all, it’s not like they get paid.

    Zero. However…..I have consulted on a few that went absolutely nowhere.It seems that the burden of proof is on the complainant. Private citizens tend not to have the full resources of investigation and documentation at their disposal.
