Long Beach West sale to feds in jeopardy despite voter approval

STRATFORD — The sale of Long Beach West to the federal government — an issue that divided Stratford officials and residents for months in 2008 — may be dead 14 months after voters overwhelmingly approved sale of the sweeping waterfront property for at least $10 million.

The deal is threatened because the 34-acre barrier beach abutting Bridgeport’s Pleasure Beach is not worth the $10 million residents were led to believe at the time by then-Mayor James R. Miron — a strong proponent of the deal — and officials for the nonprofit Trust for Public Land, an agency acting as an intermediary on the transaction. TPL was to obtain the beach initially and transfer it to the U.S. Fish and Wildlife Service.

TPL officials recently advised the town’s new mayor, John A. Harkins, the land is now worth only about $7 million, and likely even less once about 40 cottages are removed by the wildlife service in the coming months with $909,000 of federal stimulus money. Also, the sale price will be reduced even more if the land is kept as a full open-access beach once obtained by the Fish and Wildlife Service, Harkins said.

That means under terms of the contract, the deal could be killed by the town because the property value has dropped far below the $10 million estimate, according to Harkins and officials for the Trust for Public Land.

We are shocked that this would be news. This scenario was described by a blogger here (freedomofspeach: https://stratfordcharter.wordpress.com/2008/07/22/to-be-or-not-tosome-headlines-just-write-themselves/#comment-2413) when he/she said: “I must have missed the part that says even after the cottages are down the USFWS must pay $10 million, what I did see is that an appraisal would be done, I don’t think it mentioned pre demolition conditions of the appraisal, I thought it said town could terminate if they don’t get the minimum. If I am wrong let me know. And now its $1 million not $600,000??”.

Unfortunately, no one on the Council picked up on this nor did Rich Weizel and the CT Post. Repeated articles in the CT Post for the last two years (maybe a dozen articles?) have always stated that the negotiated price was $10 Million.

Of course, the original agreement is no longer accessible on the Town website. We wonder if it didn’t find it’s way into Miron’s shredder.

So the next time an official (you know…like a mayor or Police Chief?) tells you that bloggers don’t know what they are talking about, send them a link to this page.

    So let’s review.

    When we last heard from Miron, this was a major accomplishment of his reign of terror.

    It is and always was an exclusive option to purchase Long Beach West. The Trust for Public Land would attempt to raise $10 million which was the suggested retail price over the subsequent 6 years. The final price was to be decided by the Feds. The removal of the cottages and the effect on the final price was to be determined depending upon who bore the expense.

    Once again, we will use the same analogy we have used for the last two years. It is like giving a buyer an exclusive option to purchase your house. The buyer has six years to come up with the money or can walk away. In the meantime, you can’t sell it to anyone else nor can you live in it. And oh, by the way, the final price for your house will be determined by the next owner.

    And, lest we forget, who was the outstanding lawyer who negotiated this for us? Rich Buturla and Berchem Moses & Devlin!

    2 – Could be used to get McNeil + Soto + Farmer out of the oversite
    loop, due in part to McNeil’s Grievance about DeLieto …
    3 – After the Stratford HS Meet the Mayor by Chamber / LWV I had
    a couple police talk to me about a few issues.
    A) Told me his brothers told him I could give the real scoop and was
    right on about most things ….
    B) The other officer who summoned (A) told me he was police over
    20 years and SOTO was the finest officer he ever worked with.

    Jeze – were you or ANY blogger at ST JOSEPH’S when the MAYOR
    first introduced the TRUST as the intermediary for US F & W.
    I nailed the untrustworthy Mayor and the questionable TRUST set
    up as the LBW SALE would NEVER HAPPEN

    Other people got into the details of the AGREEMENT (NOT contract)
    in the Newspaper and I believe on this BLOG.
    > The AGREEMENT was as absurd as the HANNEY DEAL and the MEMO of
    UNDERSTANDING on 2001 by Town Manager MARK BARNHART + Town
    Attorney BURTURLA with TEAM STRATFORD.
    > The terms of those are as outrageous as PENSION COMPUTATIONS

    Jeze – You and your blog HAS SERVED as a VEHICLE for you, me, and other
    people to discuss the outrages in town.

    Freedomofspeach called this one precisely. Countless others correctly (and immediately) pointed out that it was not a “sale” but an option to buy.

    No one, not even you, can describe any credible evidence (memos, contracts, emails, letters) that LBW will be swapped for the airport.

    I’d like to hear what the geniuses at the CT Post editorial board have to say about this. Last month even those know-nothings were saying that Stratford “sold” the beach to USF&W and Stratford should not get in their way of removing the cottages.

    I wonder if they’d like to “clarify” their stance.

    As I have said numerous times Richard Weizel is a fine reporter and the Connecticut Post has a lot to be proud of with him. I have been on every major board in this town and lived here for over 40 years. The reporters we had in the past I saw to it that they were removed. Some would be in with the Democrats and some would be in with the Republicans they got their hands greased well and would report what each party wanted. Richard Weizel can not be bought and he doesn’t ever write anything that he can’t back up. If it weren’t for Richard Weizel we would not know what is going on in Stratford. Thank you Richard, for being an honest reporter Stratford needs this badly and thank God you have exposed some very serious issues. That have made us all aware.

    Syl-I don’t think anyone was attacking the reporter-he works with the facts that he is given and does the best job he can to substantiate them-the problem here is when you have an administration that that lies about the facts and then lies about the fact that they misrepresented the facts and tries to peddle it as fact. Jez, myself and many others repeated pointed out that the voters were being given a bill of bull pooh about the beach sale. Attorney(s) billed us as part of the “salary” and on billable hours this blatant misrepresentation to the public and the moron was the lead promoter of the deliberate fiction presentation to the public. I do believe that that is illegal-at the presentation level by both the former(than God he is gone)mayor and his legal beagle. Isn’t it called willful and deliberate fraud???????????????????????? Isn’t that punishable in the courts??????????????????????????????

    I am in full agreement with you and indeed Moron should be investigated without question. His way of life, and that of his family, has always been one of lying or using people. Ray Voccola and I stopped talking to the father years ago because he lied to us both. Ray was a very honorable person and when he gave you his word it was golden. Moron hurts the legal profession badly. It is a wonder how he ever passed the bar. Friends of mine who taught him at Stratford High School cannot believe it, either. He is a disgrace and will never amount to anything good. At least he is not doing anymore harm to our town, but I fear their are more shoes to drop if even his “greatest achievement,” the sale of Long Beach West, was a fraud. And a costly fraud at that.

    As usual you can not separate issues, where one will happen and the motive
    will be to create the other

    Issue 1 – LBW sale would never happen
    (It still may happen, like the Hanney deal, or ….)

    Issue 2 – There will be a sale of or attempted trade of LBW for Airport

    (Been on the Council Agenda 4 years)
    – I raised idea at public forum to BUY the airport about 1999 – 2000.
    – Few months later Dick Miron made rare Public Forum appearance
    to buy the Airport.

    Unfortunately Mirons and others have perverted many of my ideas.
    Occasionally it has worked for the Public, but only becase it benefitted
    the parasites.

    I take that as a failure of this blog. In the end, the purpose of this blog is to provide voters with enough information and opinion so that they can make an informed decision.

    That did not happen. Instead, the entire issue was caught up in a whirlwind of promises, half truths, irresponsibility and ineffective representation.

    The solution of course is to generate more voter awareness. How that is accomplished is not evident. The (somewhat) good news is that since late October daily readership has quadrupled, with spikes well over 1,000 readers in a day, depending on the latest fiasco.

    Jez- You may view it as a failure of the blog, I don’t. You presented the information that was factual. What I view it as is a major failure across the board. The absolute biggest Failure is of the former mayor to be honest and forth right, acting in the best interest of the town, failure of the town attorney to present the material in an honest and truthful way to the council and the public–in other words failure to do his job. Failure on the part of the town administration(including the old form of govt) to properly maintain the properties, buildings and equipment that we have, and multiple failures by the public-!st- failure to educate themselves- all they had to do is pull up the contract on the computer or go to the library and actually read it(that alone would have made them vote no) 2nd. Failure to pressure their government officials to actually represent THEM. Then of course the 2nd biggest failure comes from the council(sorry guys but it is true) Failure to allow the public to vote in a manor that stated they wanted the beach preserved but not with the contract that is presented. (Same thing should have been done with the 1st charter revision-as it was very poorly written) that at least would have provided a barometer to work within. I hope future councils and elected officials learn from these grave mistakes and don’t repeat them. Take Heed to those who read…

    Thank you. Perhaps it is my own frustration level with (obviously) the previous administration, the inability of the RTC and DTC for work for anything instead of against each other, our paid legal representative to represent anyone other than the mayor, and the snail’s pace of forward movement by the new mayor.

    Nevertheless, the more the voters know the better off we will all be.

    A good start would be dealing with Administrators who lie and corrupt the system.

    While people choose to ignore or mock my posts, there was only once
    that I intentionally went over the top, both to vent and prove point.

    Because Jeze has very strong opinions and very narrow focus, there were
    often times when Jeze took exception to the way I post viewing them as
    ANTI – SOMETHING or IRRELEVANT.

    This blog is an amusment and information conduit,

    No one has ever made any effort to advertise the blog, except me.

    This is not about you, George, as an individual. Sometimes you need to understand that you may be part of a collective accolade-the blog is a collective group of opinions-moderated by Jez. Your warnings and predictions are so lengthy and abstract that many don’t bother to read them, it’s too time consuming to try to figure them out. I’m not mocking you, just telling you straight up it’s not about you and your need for accolades(not my intent to offend-just clarify).
    What this is about is the failure of the PUBLIC and the people that REPRESENT them to do their jobs. The public is responsible for being an educated voter and those that are elected are responsible for informing the public so they can properly represent public opinion. Somewhere along the way something has gone askew and needs to be corrected. The service to the public needs to be put back into public service and that is just one of the things that Harkins is trying to do. I, for one, hope he is successful….if he succeeds so does the Town.

    Hello all. But if you recall I,as an Editor on TOPIX, blasted to one and all for many, many months (before that bogus election) that it was NEVER a sale as it was proposed to one and all but in fact a mere “OPTION” . A MAYBE, A MORE THAN LIKELY~ NO GO!!!! I also stated that ” what happen, when the “OPTION”contingent upon $$$ from a government agency when the economy was already beginning to tank. and we get stuck paying for unnecessary tear down of cottages. I also questioned where they came up with what appeared to be a “BELOW MARKET EVALUATION” of that property. I questioned who and how many appraised LBW as I was trained by one of the best in the world Norman Benedict a world renowned Appraiser often employed by clients such as Donald Trump!
    The price of that property seemed, unusually low even despite the declining market conditions!
    I had stated to the Former Mayor Miron & Councilman O’neal
    all these questions and reservations after a Town Council Meeting in ’08 when it was first proposed…..getting the brush off with no actual answers as he had no idea who or how many appraisals had been done….something was not right with that as well!
    I felt from the day this OPTION was proposed it was
    1-incorrectly evaluated
    2-too many WOPENS= WIDE OPEN!
    3-Everyone was too hasty for a deal that was no deal at all!!
    4-Rush, Rush to cut a half azz deal with an entity that had a ridiculous number of years to back out…ridiculous contingencies. SO WHAT WAS THE BIG RUSH??
    This whole thing did not sit well with me right from the get go!

    Again~ I base all the above on my professional opinion with 26 years of experience as Realtor, Licensed by the State of Ct Dept of Consumer Protection
    No one paid attention….I had also expressed my concerns to various Town Council Members appointed at that time. Everyone seemed to feel it was a “REAL DEAL OF THE CENTURY” I knew it was a crock of bull!

    Talk about the pot calling the kettle black. Was anyone more arrogant than Miron? Ever?

    Had the referendum question been phrased to reflect what was actually in the agreement the “will of the people” would have been better placed. Maybe you should have had an attorney read the ballot question first? Oh wait…you ARE an attorney aren’t you?

    We did get public input, Jimmy-we fired you by a landslide margin.
    If you actually listened at any of the LBW workshops-the people said over and over they wanted the beach preserved forever, they wanted the damn cottages removed and if the town wasn’t capable of caring for the property they wanted it to be sold to USFW for no less than $10 million dollars. That is not the contract that you executed. We never agreed to a 5 year option- that was not the language on the ballot–so be careful where you tread sir as you fraudulently and deliberately misrepresented things to the people-which is a direct violation of the charter.

    Miron, GAVIN, Kubic + friends screwed up the Charter by C.R.C. # 1

    C.R.C. # 2 led by Florek, Proto, August, including Gavins’ buddy Fahan
    screwed up the Charter, led by Henrick + Julian + Moore + GAVIN.

    GAVIN had the chatzputz to state he was against the Town Charter
    he caused changes ON BOTH C. R. C., but made no attempt to correct.

    Jeze how is that different than Miron being against the Mayor government,
    dominated by Republicans on the C.R.C for deniability, then running for
    Mayor and causing a justification for C.R.C. # 2?

    All BOVINE SCATOLOGY.

    People like Phin, Chris, Mayor 2013 and others earnestly argue against
    tissuous, specious, and absurd proposals, when it is All BOVINE SCATOLOGY.

    Stratford politics, like CT Politics, like USA => needs an enema.

    More and more regular people are starting to talk about the disparate
    Stratford issues as one HUGE piece of pending economic development.

    More and more regular people are talking about the groundhog day of
    unsolved problems and certain people making money due to causing
    problems and delaying solutions, so certain people can BILL, BILL, BILL.

    As hard headed and focused on Public Workers as Jeze is, even Jeze has
    been increasingly posting about PUBLIC INTEREST ENACTMENTS.

    Imagine if politics had consumer protection laws?

    Friday, Saturday and Sunday I had people approaching me about the Laura
    Hoydic mailings and asking me if the people who created them did it with a
    straight face?

    Laura is likely to be elected and in Hartford, with Paul on the Council.

    As Jimmy wrote about being careful what you ask for …..
    He is one with virtually NO DENIABILITY despite the ANTICS …..

    One of these days, certain people are going to look in the mirror ….
